Federalism still running sans laws: PM Prachanda

Prime Minister Pushpa Kamal Dahal 'Prachanda' has said that some laws related to the implementation of federalism are yet to be amended and constructed even though the basic structure is prepared for the execution of the federal governance system.

"Although the people's representatives had been elected and had completed one term, there was ambiguity in many places in absence of legal provisions," he said at the high-level discussion on the draft report on the work expansion revision organised at Singha Durbar on Sunday.

Mentioning that some laws are yet to be amended and enacted, Prime Minister Prachanda said that during the practice of running the government, the need for expansion and amendment was felt while the provincial and local levels also demanded for the changes. "Therefore, the amendment process of the laws was advanced," he said.

According to PM Prachanda, after the promulgation of the constitution, the federal governance system based on the principles of cooperation, coexistence and coordination is being practiced.

He said that in the eight years since the promulgation of the constitution, the country has achieved encouraging achievements. The basic structures necessary for the implementation of federalism have been built in a short time.

Arjun Prasad Pokharel, Coordinator of the committee, presented the progress made at the work expansion. Likewise, Dr. Somlal Subedi, speaking as an expert on the topic, informed about the main theoretical criteria adopted for the work expansion and the scope of work of the federal, provincial and local level. The participants presented their views on the security, governance, law, and socio-economic sectors.

Dr. Subedi presented the solutions related to the work division among the various levels of the government, and said that the federal level should look after the matters related to the nature of regulation, standards and uniformity across the country.

Likewise, development, infrastructure, regional coordination and promotion should be managed by the province and service delivery by the local level.

Dr. Subedi informed that arrangements should be made to allow provincial or local authorities to exercise their rights in accordance with the federal laws.

In order to remove the duplication and ambiguities seen in the implementation of federalism, the meeting of the National Coordination Council held in June 2023 decided to form a work expansion revision and recommendation committee.

The work expansion of the list of single and common rights of the federation, state and local level mentioned in schedule 5 to 9 of the constitution was approved by the Cabinet in January on 18 January 2016, and is being implemented.

Deputy Prime Ministers, chairmen of the House Panels of the National Assembly and the House of Representatives, lawmakers, leaders of various parties, chief secretary and secretaries of various ministries and experts were present in the discussion.
