The Supreme
Court has ordered Yashoda Foods not to copy the trademark of Wai Wai noodles. Joint
bench of Justice Kumar Regmi and Abdul Aziz Musalman on August 16 upheld the
verdict of the Patan High Court and ordered Yashoda Foods, the producer of
Current noodles, not to copy Wai Wai’s trademark.
CG Foods
Nepal Limited, the producer of Wai Wai, went to court to stop Current Noodles from
copying the trademark of Wai Wai. The Patan High Court then gave the verdict in
favour of CG Foods. Yashoda Foods had gone to the Supreme Court challenging the
verdict of the high court and demanding that it should be allowed to use a
trademark similar to that of Wai Wai.
“Yashoda
Foods copied the trademark of Wai Wai with the intention of misusing the fame
that our brand has gained in Nepal and abroad with various efforts in the last
four decades. It was also deceiving the consumers,” CG Food said in a statement
on Sunday.
Yashoda
Foods had tried to register the trademark that was similar-looking to Wai Wai.
However, the High Court had ordered the Department of Industry to cancel the
trademark registration process.
CG Foods
said that according to this order, Yashoda Foods has to return the Current
noodles (that look like Wai Wai) sent to the market. If they are sold in the
market, it would be the defamation of the court.
